Unsecured database compensation claims

corporate data breach victims

Many companies hold customer and employee information in huge databases, many of which can be accessed online or in the cloud as a way of making them easier to use from any location. But with ease of access comes the necessity of appropriate cybersecurity defences to prevent unauthorised users from breaching the database. Unfortunately, some organisations do not take these precautions seriously. Where information is stolen from an unsecured database, compensation claims could be launched by those affected.

In the Virgin Media data breach, the failure to secure a database resulted in the exposure of approximately 900,000 victims’ personal information, making it accessible to unauthorised users. We believe the company is responsible for negligence in terms of data protection law, which is why we are giving all those affected by the incident the opportunity to make a compensation claim in our group action.

Virgin Media’s unsecured database – who is at fault?

The Virgin Media data breach was caused by a vulnerability in a marketing database that held hundreds of thousands of people’s details. In total, the database was left open for ten months, during which it could be accessed by unknown users.

In their statement on the incident, Virgin Media confirmed that the flaw was a configuration error for which an employee was responsible. However, in our eyes, this is a rather narrow view of the situation. It may be that the breach was initially provoked by the error of one employee, but it should have been noticed much sooner by routine monitoring and checks, so it is not just one person who is to blame. Plus, this should not have happened in the first place in our view either.

For victims who had their data exposed in Virgin Media’s unsecured database, compensation claims could, therefore, be brought against the company as a whole for failing to prevent and react to the error.

Unsecured database compensation claims

In our lawsuit against Virgin Media for its unsecured database, compensation claims could provide a route to justice for the claimants. Your personal information should never have been compromised in this way, and you have a right to compensation for any distress or financial losses caused by the incident.

Financial loss may arise in situations where fraudsters have used contact details stolen in the Virgin Media data breach to target victims with malicious communication, which is often designed to trick victims into disclosing their bank account or payment card details. You could be eligible to recover money lost to fraud as part of your claim.
