Unlawfully accessing records can amount to a breach of the GDPR on the part of the company whose records have been accessed, if there was more that they could – and should – have done to have prevented the incident from taking place.

In the Virgin Media data leak that came to light in early 2020, it was discovered that third parties had been unlawfully accessing records of some 900,000 people as a result of a database configuration problem. One of those who accessed the information was a third-party security researcher who alerted Virgin Media to the problem, but there was also another unknown access event by a third party as well.

There should never be cases of third parties unlawfully accessing records because the duty that an organisation has to protect the information in their charge is clear in law.
