Our Virgin Media data breach group action is well underway, and we now represent a large number of clients for cases on a No Win, No Fee basis.
If you have yet to sign up for a legal case, you should do so as soon as you can. You could be entitled to claim thousands of pounds in damages for any distress suffered by the loss of control of your personal information.
Here’s some information about the action and what to expect if you have yet to start your case.
The Virgin Media data breach group action is the pursuit of compensation from the telecoms provider for causing the exposure of data for some 900,000 people. The data was left unsecure and accessible online between April 2019 and February 2020 before it was discovered by a third-party security researcher.
During the breach period, it is understood that at least one unknown third-party accessed the information.
In accordance with the GDPR, victims of the data leak could be entitled to claim compensation for any distress caused by the loss of control of their personal information. You do not have to have suffered any losses or expenses to be able to claim, but these can be considered as well if they are applicable as well.
When we spoke to the media in recent weeks, we confirmed that claims could be valued in the region of up to £5,000.00.
The Virgin Media data breach group action that we are pursuing has not been formed into a formal court-ordered Group Litigation Order (GLO). This is where a Judge, usually at a High Court, will order that all Claimants are to be grouped together to be a part of one set of proceedings.
It is the efficient way of making sure that anyone who is claiming can pursue their cases and resolve the common issues together. Common issues are usually things like general liability and eligibility for a settlement.
Given the volume of people affected, we expect that a GLO will likely be formed in the future. Just last year, one was formed for the British Airways Data Breach Action, and our firm was appointed to the Steering Committee that is responsible for the overall conduct of the litigation. This has sealed a deadline in place for people to secure their cases, and it is likely that a similar course will follow in this Virgin Media action also.
If it does, our clients will be able to join the GLO with our expert representation.
