In our view, Virgin Media is liable for a data breach claim for anyone who was affected by the 2020 information leak incident. In this incident, some 900,000 people had their information left exposed online for a considerable period of time: for almost 10 months between April 2019 and February 2020. This exposure occurred due to the incorrect configuration of a database which, in our view, is a completely avoidable event and has arisen from negligence.
The fact that it was not identified that the information had been exposed for 10 months, and it was only identified by a third-party security researcher, further shows that Virgin Media should be liable for a data breach claim for anybody who brings one, having been affected by this incident.
